Larry Ribstein’s take is worth a read.
There is certainly a difference between giving pre-act advice to a corporation and post-act advice to someone accused of a crime.
The better analogy would have been whether you would refuse to advise someone thinking about committing a rape or murder.
This kind of advice attorneys do all the time, about the conduct that the person would engage in is illegal. I have allways said to my clients if you do X, it is against the law.
OK Rex.
Assume that your corporate client does X and it is against the law. If you are corporate counsel, do you resign? If you are outside counsel, do you “fire” the client?
Assume that X is immoral, but not illegal. What do you do?

I don’t think the Ribstein question is well formulated either. So even criminals (rapists, murederers, etc) don’t deserve representation?
